The claim for debts, derived from the Royal Legislative Decree 1/2015, of July 24, which approves the revised text of the Law on Guarantees and rational use of medicines and health products, encompasses the following procedures:

Claim of debts in voluntary proceedings.
Article 125.3 of the TRLGURM, in its current wording as of June 28, 2023, provides as follows:
“The collection management of the fees regulated in this law corresponds, in voluntary proceedings, to the Ministry of Health and the Spanish Agency of Medicines and Health Products, according to their respective competence.”
Once the debt and the debtor have been identified by the department that provides the service, the AEMPS will initiate ex officio the debt claim in voluntary channels, where the amounts due corresponding to the services provided by the AEMPS will be detailed.
In the case of submission of allegations, the interested party has to send the allegation letter and the supporting documentation he/she wishes to provide by the means admitted in law (Law 39/ 2015, of October 1, of the Common Administrative Procedure of the Public Administrations, given the obligation to relate by electronic means established in article 14):

Claim of debts in executive proceedings
Once the voluntary procedure has been exhausted without payment/settlement of the debt, the AEMPS initiates ex officio the enforcement claim procedure.
El The Agreement between the State Agency of Tax Administration and the Spanish Agency of Medicines and Medical Devices, for the enforcement collection of the resources of a public nature of said entity, states that:
“The Spanish Agency of Medicines and Medical Devices (AEMPS) and the Tax Agency agree that the collection of public fees and penalties managed by said Entity will be carried out through the collection bodies of the Tax Agency”.
